AI cannot be named as patent ‘inventor’, UK supreme court

The UK's highest court has decided that artificial intelligence cannot be legally recognized as an inventor to obtain patent rights. This verdict was reached in the case of US scientist Dr. Stephen Thaler, who had a conflict with the Intellectual Property Office (IPO) over his attempt to name an AI, called DABUS, as the inventor for two patents. Thaler argued that DABUS independently invented a container for food or drink and a light signal, and he should have rights over its inventions. However, the IPO denied this, saying that an inventor must be a human under current law.

The lower courts had already confirmed this decision in 2020 and 2021. The Supreme Court, in a unanimous decision, concurred with the IPO, saying that DABUS is not a human and did not create any invention. Therefore, it could not be an inventor according to the Patents Act 1977. The court also rejected Thaler's claim that he should get the patents as the AI’s owner, pointing out that DABUS is a device with no legal identity and Thaler has no separate right to a patent for any of its technical innovations. This case was closely monitored due to the growing attention to AI developments and their effects in various sectors.
